Terms of Service

These terms govern worker, advocate, and visitor access to Makewrk referral links, contact routing, reward tracking, and paid plans.

1. Agreement and eligibility

By creating an account, accepting an invitation, using a referral link, or otherwise using Makewrk, you agree to these Terms, the Privacy Policy, the Reward and Refund Policy, and the Acceptable Use Policy. You must be at least 18 years old and able to enter a binding contract. If you use Makewrk for a business, you confirm that you can bind that business.

2. What Makewrk provides

Makewrk helps service businesses create advocate referral links, route inbound contacts, count qualifying contacts, fund referral rewards, and track reward status. Makewrk is not the service provider, employer, agent, or guarantor of any worker or advocate. We do not guarantee service quality, job availability, lead quality, or any specific business result.

3. Accounts and phone verification

You must provide accurate information, control the phone number used for verification, and keep account access secure. You may not share verification codes or impersonate another person or business. Tell us promptly if your phone, payout details, or business information changes.

4. Worker responsibilities

Workers are responsible for the truthfulness of their public card, the people they invite, the reward amounts they set, compliance with referral and advertising laws, and all services they provide. A worker must have a lawful reason to provide an advocate's phone number and must not enroll, message, or pressure someone who did not agree to be contacted.

Starter uses a shared inbound text number. Pro can provide a dedicated inbound number for calls and texts that are forwarded to the worker's mobile phone. A direct reply from the worker can expose the worker's regular phone number and may not be tracked by Makewrk.

5. Advocates and qualifying contacts

Advocates may share only lawful, truthful recommendations. A qualifying contact is a new unique person who contacts the worker through the applicable Makewrk flow and passes the current eligibility and fraud checks. A phone number can count only once for a worker under the current product rules. Opens, taps, spam, repeat contacts, excluded numbers, and ambiguous or fraudulent activity do not count.

Makewrk may place activity under review, correct an attribution error, reject activity that violates these policies, or require reasonable supporting information. Current product rules, not screenshots or informal messages, determine progress.

6. Rewards, fees, and subscriptions

The worker sets the per-lead reward an advocate earns for each qualifying contact. There is no upfront funding: Makewrk bills the worker's saved card weekly, in arrears, for the qualifying contacts counted that week. Each counted contact is charged as the advocate reward plus Makewrk's platform fee for the worker's plan at the time the contact counts; the fee is added on top of the reward and is never deducted from it. Pro is a recurring subscription that lowers the per-contact platform fee and adds paid-tier features while an eligible subscription is active. The current fee percentages are disclosed on the pricing page and before a card is saved. Payment processing, tax, chargeback, and third-party provider terms may also apply.

A counted qualifying contact makes its reward payable under the Reward and Refund Policy. Payout timing depends on settlement, completed payout setup, review, provider availability, and banking networks. Displayed balances are records of status, not bank accounts or deposit accounts.

7. Billing and cancellation

You authorize charges shown at checkout. A Pro subscription renews until canceled. Cancellation normally takes effect at the end of the paid billing period. Weekly lead billing, refund, chargeback, and platform-fee rules are described in the Reward and Refund Policy. You are responsible for taxes tied to your business, rewards, and earnings unless the law requires Makewrk to collect or report them.

8. Suspension and termination

We may limit, suspend, or close access to protect users, investigate fraud, comply with law or provider rules, or enforce these policies. We will preserve and resolve lawful outstanding financial obligations as required, even if account access is restricted. You may stop using Makewrk at any time, but existing payment, dispute, tax, and policy obligations survive.

9. Disclaimers

Makewrk is provided on an "as is" and "as available" basis to the fullest extent allowed by law. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free contact delivery, attribution accuracy, payment-provider availability, or any specific business result. Nothing in these Terms excludes or limits rights or liabilities that cannot legally be excluded or limited.

10. Limitation of liability

To the fullest extent permitted by law, Makewrk and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business, arising out of or relating to your use of Makewrk, whether based in contract, tort, or any other theory, even if advised of the possibility.

Makewrk's total liability for all claims relating to Makewrk in any twelve-month period will not exceed the greater of the amounts you paid Makewrk in platform fees and subscription charges during that period, or one hundred U.S. dollars ($100). A funded reward that becomes payable to an advocate is governed by the Reward and Refund Policy and is not a Makewrk liability for damages. These limits do not apply to liabilities that cannot be limited under applicable law.

11. Indemnification

You will indemnify and hold harmless Makewrk and its owners, employees, and suppliers from any claim, loss, or expense (including reasonable legal fees) arising from your content, the services you provide, the referrals or messages you send, your public card, your tax obligations, or your violation of these Terms, the incorporated policies, or applicable law. Makewrk may control the defense of any matter for which you are obligated to indemnify us, and you will cooperate in that defense.

12. Dispute resolution and governing law

Before starting a formal proceeding, you agree to contact us at hello@makewrk.com and try in good faith to resolve the dispute informally for at least 30 days. Any dispute that is not resolved will be settled by binding arbitration on an individual basis, and you and Makewrk waive any right to a jury trial or to participate in a class or representative action. Either party may still bring an eligible claim in small-claims court, and either party may seek injunctive relief to protect intellectual property or prevent misuse of the service.

These Terms are governed by the laws of the U.S. state in which Makewrk's operating entity is organized, without regard to conflict-of-laws rules. Except for claims that must proceed in arbitration or small-claims court, you and Makewrk submit to the exclusive jurisdiction of the state and federal courts located there. If any provision of this section is found unenforceable, the remainder stays in effect.

13. Changes and contact
